VEHICLE SALES TERMS & CONDITIONS

1. Definitions

In these Terms and Conditions:

"Company", "MCS Motor Group", "we", "our" and "us" means MCS Motor Group and any associated trading entity involved in the sale of the vehicle.

"Customer", "you" and "your" means the purchaser of the vehicle."Vehicle" means any motor vehicle supplied by MCS Motor Group.

"Warranty" means any warranty supplied by MCS Motor Group or any third-party warranty provider.

"Deposit" means any reservation or holding deposit paid by the customer.

2. Vehicle Condition

2.1 All vehicles supplied by MCS Motor Group are used vehicles unless otherwise stated in writing.

2.2 Due to the age, mileage and nature of used vehicles, customers should expect reasonable wear and tear, age-related deterioration and minor cosmetic imperfections.

2.3 Customers are encouraged to inspect and test drive the vehicle prior to purchase and satisfy themselves that the vehicle is suitable for their requirements.

2.4 Any known defects disclosed prior to sale shall be deemed accepted by the customer upon completion of the purchase.

2.5 Photographs, videos and advertisements are provided for illustration purposes only and may not show every cosmetic defect, repair or imperfection.

2.6 Customers are responsible for inspecting the vehicle prior to collection and reporting any concerns before taking delivery.

3. Warranty Cover

Unless otherwise stated on the sales invoice, all vehicles supplied by MCS Motor Group are provided with a 6 Month or 6,000 Mile Warranty (whichever occurs first) from the date of purchase.

Additional warranty cover may be available at extra cost.

Nothing within this warranty affects the customer's statutory rights.

4. Warranty Exclusions

Wear and Tear, Servicing and Maintenance

The warranty does not cover:

  • Tyres
  • Brake discs and pads
  • Clutch assemblies
  • Wiper blades
  • Bulbs
  • Filters
  • Fuel
  • Oil
  • Coolant
  • Screen wash
  • Servicing
  • MOT testing
  • Consumable items

Labour required to replace excluded items is also excluded.

Air Conditioning

The warranty does not cover:

  • Air conditioning re-gas
  • Air conditioning leaks
  • Compressors
  • Condensers
  • Air conditioning pipes
  • Air conditioning components
  • Air conditioning diagnostics and repairs

Cooling System Components

The warranty specifically excludes:

  • Water pumps
  • Radiators
  • Thermostats
  • Coolant hoses
  • Expansion tanks
  • Heater matrixes
  • Cooling fans
  • Cooling system sensors
  • Associated cooling system components

Hybrid and EV Components 

The warranty does not cover:

  • Hybrid batteries
  • Auxiliary batteries
  • Battery management systems
  • Inverters
  • EV batteries
  • Charging systems
  • Hybrid cooling systems
  • Associated electrical control modules

Improper Care, Use or Damage 

The warranty does not cover repairs required due to:

  • Failure to service the vehicle correctly
  • Failure to maintain oil, coolant or fluid levels
  • Use of incorrect fuel or lubricants
  • Continued use after warning lights or fault symptoms appear
  • Overheating
  • Misuse or neglect
  • Collision damage
  • Flood damage
  • Vandalism
  • Vehicle modifications
  • Racing or competition use

Commercial Use Exclusion

Warranty cover becomes void if the vehicle is used for:

  • Taxi services
  • Private hire
  • Uber
  • Bolt
  • Chauffeur work
  • Commercial hire
  • Vehicle rental
  • Delivery services
  • Hire and reward activities

Unless expressly agreed in writing.

Age and Mileage Related Failures

The warranty does not cover:

  • Age-related deterioration
  • Mileage-related failures
  • Corrosion
  • Water ingress
  • Carbon build-up
  • Blocked filters
  • Cosmetic defects
  • Paintwork defects
  • Interior trim defects
  • Preventative maintenance items

Manufacturer Recalls

The warranty does not cover:

  • Manufacturer recalls
  • Manufacturer goodwill repairs
  • Existing manufacturer defects
  • Components covered by manufacturer or supplier warranties

Third Party Warranty Products

Where a third-party warranty product is supplied, including National Warranty products, this creates a separate contractual arrangement between the customer and the warranty provider.

MCS Motor Group accepts no liability for decisions made by the third-party warranty provider.

5. Diagnostic Inspections

MCS Motor Group reserves the right to inspect any vehicle subject to a warranty claim.

Where a warrantable fault is identified, diagnostic costs may be covered.

Where no warrantable fault is identified, MCS Motor Group reserves the right to charge a reasonable diagnostic fee to cover testing and inspection costs.

By authorising an inspection, the customer agrees to these terms.

6. Imported Vehicles

Imported vehicles may differ from UK specification vehicles in relation to:

  • Navigation systems
  • Multimedia systems
  • Radio frequencies
  • Language settings
  • Software versions
  • Manufacturer support
  • Parts availability
  • Optional equipment
  • Vehicle specifications

The customer is responsible for ensuring the vehicle specification meets their requirements prior to purchase.

7. Reservation Deposits

Reservation deposits are taken to secure a vehicle and remove it from sale.

Where a customer cancels after reserving a vehicle, MCS Motor Group reserves the right to retain all or part of the deposit to cover reasonable costs incurred.

Such costs may include:

  • Administration
  • Vehicle preparation
  • Valeting
  • Advertising
  • Marketing
  • Transportation
  • Inspection costs
  • Lost sales opportunities

An administration charge of up to £150 plus VAT may be deducted from any refundable deposit.

Any deduction shall be reasonable, proportionate and reflect actual costs incurred.

Nothing within this clause affects the customer's statutory rights.

8. Payment & Outstanding Balances

Full payment must be received before collection unless otherwise agreed in writing.

Where a vehicle is released prior to payment in full, any outstanding balance remains payable in accordance with agreed payment terms.

MCS Motor Group reserves the right to pursue recovery of unpaid balances together with:

  • Court fees
  • Statutory interest
  • Recoverable legal costs
  • Debt recovery costs where permitted by law

9. Retention of Title

Ownership of the vehicle shall remain with MCS Motor Group until all monies due under the sales agreement have been paid in full.

Nothing within this clause affects the customer's statutory rights.

10. Vehicle Returns 

Nothing within these Terms and Conditions removes or restricts any rights available under the Consumer Rights Act 2015 or any other applicable legislation.

Where deductions are permitted by law, MCS Motor Group reserves the right to make reasonable deductions for:

  • Excessive use
  • Undue mileage accrued 
  • Damage beyond fair wear and tear
  • Missing keys
  • Missing documentation
  • Missing accessories
  • Repair costs arising from customer damage
  • Reduction in vehicle value caused by the customer's use

11. Vehicle Damage 

The customer shall be responsible for damage occurring whilst the vehicle is in their possession.

MCS Motor Group reserves the right to recover the reasonable cost of repairs required to rectify damage beyond fair wear and tear.

12. Distance Sales Scheme Statement

MCS Motor Group does not operate an organised distance selling scheme as defined by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

If a customer chooses not to view a vehicle prior to purchase, they will not automatically be entitled to cancellation rights applicable to organised distance sales contracts.

All other statutory rights remain unaffected.

Unless otherwise agreed in writing, the customer shall be responsible for the cost of returning any vehicle.

13. Limitation of Liability

To the fullest extent permitted by law, MCS Motor Group shall not be liable for:

  • Loss of earnings
  • Loss of profits
  • Loss of business
  • Loss of use
  • Hire vehicle costs
  • Accommodation costs
  • Travel expenses
  • Consequential losses
  • Indirect losses
  • Delays in repairs
  • Parts supply delays
  • Manufacturer support issues

Nothing within these Terms excludes liability that cannot legally be excluded.

14. Data Protection

Customer information may be collected, stored and processed for:

  • Vehicle sales
  • Vehicle registration
  • Warranty administration
  • Debt recovery
  • Fraud prevention
  • Regulatory compliance
  • Customer service
  • Legal proceedings

Information may be shared where reasonably necessary with:

  • DVLA
  • Warranty providers
  • Finance companies
  • Insurers
  • Solicitors
  • Debt recovery agencies
  • Regulatory authorities

All personal data shall be processed in accordance with UK GDPR and the Data Protection Act 2018.

15. Acceptance of Terms

By paying a reservation deposit, making payment for a vehicle, signing any sales documentation, accepting delivery or collecting a vehicle, the customer confirms that they have had the opportunity to review these Terms and Conditions and agree to be bound by them.

These Terms and Conditions are available on request and published on the MCS Motor Group website.

16. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
